Fennell was sentenced to life in . He worked for both J(oseph?) and William Archer, mainly fencing but also felling and cutting logs. He was punished a number of times with the lash, including multiple episodes of 50 lashes. In he was reported for ‘gross insubordination and failing to go to Norfolk Plains in custody of the constables for the purpose of being examined by the magistrate.’ He was imprisoned and kept to hard labour in the house of corrections for two years.

In January 1841 Fennell received his conditional pardon and had applied to marry by September of that year. However he died shortly after in at the age of 42, with the cause of death ‘asthmatic’.
